Pudding Fairy –  Terms & Conditions

Please find below Pudding Fairy’s terms and conditions. You should read them carefully and print out a copy for
your future reference. By accepting your quote and proposal for your cake or experience, you are agreeing to these terms and conditions.
About us -www.puddingfairy.com is a website operated by Pudding Fairy, bespoek Patisserie and chocolate art, owned by Laure Moyle. Pudding Fairy is registered at 53 The Sands, Ashington, West Sussex, RH20 3LQ.

Experiences – Pudding Fairy offers a range of interactive live demonstrations at events, team building and private classes and Hen Do parties. Those are refered to as “experiences” in this document.

Deliveries –  Pudding Fairy offers a free of charge delivery service within 10 miles of our production kitchen (calculated from our registered post code). Beyond this limit, Pudding Fairy charges 45p /mile (return mileage) for deliveries to West Sussex, East Sussex, Hampshire, Kent and Surrey. For orders going further and abroad, Pudding Fairy works with  food couriers and specialist delivery partners. Please contact us for a delivery price quote.

Collection option – Please let us know if you wish to collect your cake -from our kitchen. Please do let us know when you will be arriving so thatwe can have it ready for your arrival in a cake box. We can also provide heavy duty insulated food boxes for single tier cake sizes up to 12inch in diametre, at the cost of £20.00 each. You (or a representative nominated by you) will be asked to sign a confirmation form upon collection or delivery and setup of the cake. Please note that we cannot be held liable for any damage made to the cake after this time; including transportation, storage or inadequate placing after delivery. Full payment must have been received by us in cash or cleared funds to ensure that your cake isavailable for collection or delivery.

Set up – Delivery and set up time is calculated for your bespoke quote taking into account any on-site finishing time. If the circumstances change on the day and we have to spend more time than estimated on-site to finish the set-up for your order due to another supplier/your venue, we reserve the right to charge this extra time to you, payable upon reception of your invoice, at a rate of £20.00 per hour.

Portion Guide – Your final quote will detail a number of portion based on our portion guide, and be sent to your caterer for information. Portion guides are intended as a guide only. The final number of portions you will get from your cake will vary dependent upon how the chef/venue cuts the cake.

Minimum order – Minimum order is £50 excluding delivery costs and any special offer that might apply to your order.

How long in advance do you need to order – We kindly request a minimum of 14 days notice for celebration cakes, 6 weeks for wedding cakes and experiences. If you want to order at shorter notice, please call rather than email – if we can help, we certainly will.

Prices and quotes – Prices are liable to change at any time, but any changes will not affect orders which we have already accepted. Dates will be held once your deposit is received. Quotations should be accepted within one month or will lapse.

Fresh flowers – If your cake requires fresh flowers, then these are not included in the price unless otherwised specified (for example, if Pudding Fairy provides Organic Edible Flowers – Sourced from a specialist UK supplier). We are always happy to liaise with your florist and send them a copy of your personalised cake sketch to prepare all the flowers. Please note that Pudding Fairy are not responsible for any problems with your fresh flowers. We cannot take responsibility for any damage rendered to the cake caused by a floral arrangement if it was implemented by your florist. We are always happy to dress your cake with the floral arrangements ourselves. If fresh flowers are used, the cake will be set up as late as feasibly possible to ensure their freshness throughout the day. Depending on the varieties used & the weather conditions at the time, it may be necessary to cut the cake relatively early on in the proceedings to ensure their freshness for the photography.

Cake booking confirmation – We kindly request a £100 deposit to secure your order (for orders over £200), OR 50% deposit for orders below £200. Deposits are non refundable. The balance of your order is payable no later than 3 weeks before your delivery date. Deposit, balance and any monies owned can be paid by BACS only.

Experiences booking confirmation – All experiences are payable in advance in full, upon confirming your booking and non refundable once booked.

Cancellation policy – You can cancel your order up to 3 months prior to your delivery date for wedding cakes, wedding favours and corporate orders. For celebration cakes, you can cancel your order up to 1 month prior to your delivery date. Your deposit (which acts as your admin charge) is non refundable. However any additional monies paid in towards the balance of your order will be refunded within 28 days. Your order is payable in full if you decide to cancel it less than 3 months before your

Final design and order – Each cake is made individually by hand at Pudding Fairy, so although every effort is made to ensure consistency, a small amount of variation may occur from the design requested / picture supplied / Sketch provided.

Making changes to your design and order -We aim to be as flaxible as possible at Pudding Fairy. You can make small chages/alterations to your order,  cake flavours and agreed design up to 3 weeks prior to your delivery date. Please note that changes requested may occur additional charges to your order.

Allergies – Pudding Fairy create cakes for people with specific dietary requirements (gluten free, dairy free, nut free). Please be aware however, that our kitchen may contain traces of other ingredients incuding allergens. Our liability with regards to ingredients used is limited to ingredients used in your order, which will be clearly listed with your caterer and listed in your proposal on request.

Liability – Our liability to you is limited to the price of the cake and we cannot be held responsible for any
indirect losses which may happen as a consequence of any breach by us of these terms however arising. However, this does not include or limit in any way our liability for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
Public liability (events) – Pudding Fairy holds a public liability insurance for up to £1million.
Kitchen inspection and registration – Our kitchen is fully registered with Horsham Council, with hygiene rating of 5 out of 5.
Events outside our control- We cannot be liable or responsible for any failure to perform, or delay in performance of, any of our
obligations under these terms that is caused by any act, event, non-happening, omission or accident
beyond our reasonable control.
Revisions to these terms and conditions – We have the right to revise and amend these terms and conditions. However, you will be subject to the terms and conditions in force at the time that you place your order with us.
Law and jurisdiction – These terms and conditions will be governed by English law.
